Terms of Service

Last Updated: October 8, 2026

Welcome to On Point Construction, a trade name operated by Gomes & Benjamim LLC. By using our website, requesting an estimate, scheduling services, or communicating with On Point Construction, you agree to these Terms of Service.

1. Services

On Point Construction provides construction, renovation, repair, project coordination, and related services for residential and commercial clients.

Specific details regarding the scope of work, pricing, materials, payment schedules, project timelines, and other project conditions will be provided through applicable estimates, proposals, invoices, work orders, change orders, or written agreements.

The terms of any specific written agreement, proposal, estimate, or work order may supplement or supersede these general Terms of Service for that particular project.

2. Estimates and Pricing

Estimates and proposals are based on the information and conditions reasonably known at the time they are prepared. Actual project costs may change if site conditions, material costs, client requests, or other circumstances differ from the original assumptions.

Additional work outside the approved scope may require a written change order and additional payment.

3. Payments

Payments are due according to the payment terms stated in the applicable estimate, proposal, invoice, work order, or written agreement.

If required payments are not received when due, On Point Construction may suspend, delay, or reschedule services until the account is brought current, subject to applicable law and the terms of the applicable agreement.

Deposits, materials purchased or ordered for a project, and completed labor may be non-refundable where permitted by applicable law and the applicable agreement.

4. Scheduling and Cancellations

Clients are expected to provide reasonable notice when cancelling or rescheduling appointments or scheduled work.

Last-minute cancellations, repeated rescheduling, denied site access, or no-shows may result in additional scheduling, mobilization, or service fees where permitted by applicable law and the applicable agreement.

Project schedules may also be affected by weather, material availability, inspections, permitting, subcontractor availability, site conditions, or circumstances beyond our reasonable control.

5. Changes to Work

Any work requested outside the original approved scope may require a written change order.

Change orders may include additional labor, materials, equipment, permits, project management, or other costs associated with the requested change.

On Point Construction is not required to perform additional work until the applicable change order or authorization has been approved, except where otherwise agreed in writing or required by applicable law.

6. Property Conditions and Unforeseen Conditions

Construction and renovation projects may involve conditions that are not visible or reasonably discoverable before work begins.

On Point Construction is not responsible for pre-existing defects, concealed conditions, structural issues, utility conditions, water damage, mold, code violations, deterioration, or other conditions that were not caused by our work.

If unforeseen conditions are discovered during a project, additional work, materials, time, or costs may be required. Where appropriate, such work may be addressed through a change order or other written authorization.

We are responsible for work performed by us in accordance with the applicable agreement and applicable law.

7. Client Responsibilities

Clients are responsible for providing reasonable access to the property and work areas as necessary for the performance of services.

Clients should also provide accurate information regarding the property, project requirements, existing conditions, and any known issues that may affect the work.

Delays caused by lack of access, inaccurate information, client-requested changes, or other client-related circumstances may affect project schedules and costs.

8. Subcontractors and Third-Party Services

Depending on the nature of a project, On Point Construction may work with subcontractors, suppliers, vendors, licensed professionals, or other third-party service providers.

Where applicable, project work will be coordinated in accordance with the applicable agreement and applicable law.

9. Permits, Inspections, and Compliance

Certain construction or renovation projects may require permits, inspections, approvals, or compliance with applicable federal, state, county, or municipal requirements.

Where permit or inspection services are included in the applicable agreement, On Point Construction will coordinate those services as agreed.

Permit requirements and government approvals may affect project schedules and costs.
